General terms and conditions

for the Kärcher online shop

1. Scope

1.1 The following terms and conditions (“Terms”) apply to all contracts that Kärcher Singapore Private Limited (hereinafter referred to as “Kärcher”) enters into with consumers for transactions that arise out of or takes place at the online shop that Kärcher manages and operates in Singapore (“Purchase Agreement”).

1.2 A consumer is defined as any individual entering into the contract to purchase goods and services for his personal use (“Customer”).

1.3 Orders and deliveries can only be made within Singapore. The contract language shall be in English.

1.4 Overseas Customers, who are not residing in Singapore, should contact the national Kärcher online shop in their respective countries (information at www.karcher.com).

2. Contract conclusion

2.1 Products, including but not limited to equipment, accessories and detergents, available on Kärcher’s online shop are non-binding offers to the Customers to order and purchase the goods. Kärcher reserves the right to make technical and product changes to its online shop.

2.2 Products can be selected from those on offer, placed in a basket and submitted as an order. Before Kärcher dispatches the order, Customers will be able to review the information provided, including but not limited to the product designation, quantity, name of the Customer, the Customer’s shipping and billing address, the method of payment, and the Customer can change his details if necessary.

2.3 Kärcher will confirm all orders placed by the Customers by sending to its Customers e-mail receipts of the orders (“Order Confirmation”). However, the Order Confirmation does not represent Kärcher’s acceptance of the order. A contract to purchase is only established when the goods are dispatched to the customer.

2.4 These general Terms can be printed out or saved by customers.

2.5 Customers can save or print out orders directly after submitting the orders and tracking the orders’ status at Kärcher’s website at www.kaercher.com/sg. Customers are also provided with the contract provisions and the general terms and conditions that govern the orders with the order confirmations.

2.6 Kärcher is entitled to limit orders to common household quantities. This refers to both the quantity of ordered products as part of an order as well as several orders for the same product where the individual order accounts for a common household quantity.

3. Prices, costs for shipment

3.1 All prices shown in the online shop include the applicable Goods and Services Tax (“GST”).

3.2 Deliveries are subjected to a charge of SGD$25.00 (not inclusive of prevailing GST) or such sums as Kärcher may from time to time impose and as reflected in its online shop. The delivery costs are shown before the orders are submitted. Delivery is provided free for orders of above SGD$200 or such other sums that Kärcher may from time to time determine and as stipulated in its online shop.

4. Payment, default

4.1 Payment can be made with a valid Visa / Master Card credit card.

4.2 If for any reason, the Customer’s credit card payment is declined or reversed, the Customer is obliged to pay on receipt of the goods, the purchase price thereof plus any other incidental costs (including but not limited to any processing costs charged by the credit card (if any) within a period of ten (10) days.

4.3 In the event of default in payment, the Customer shall pay Kärcher a default interest at the rate of five percent (5%) above the annual per annum interest rate established by the Monetary Authority of Singapore. If Kärcher is able to prove a higher loss due to the Customer’s default, Kärcher is entitled to recover the higher amount.

5. Retention of title

5.1 Goods delivered shall remain the property of Kärcher until the Customer has paid the purchase price in full.

6. Delivery

6.1 Kärcher is entitled to make partial deliveries as it deemed reasonable. Deliveries will only be made on Mondays to Fridays (9.00 am to 5.30 pm) during office hours, not including Public Holidays or Eve of Public Holidays.

6.2 If Kärcher is unable to deliver the Customer’s ordered goods because the supplier does not fulfill its contractual obligations, Kärcher is entitled to rescind the Customer’s Purchase Agreement. In this case, the Customer will immediately be notified that the product is unavailable and be directly refunded any payments made and no further claims shall be brought or maintained against Kärcher upon refund of such payments.

6.3 Specified delivery dates are approximate dates and should be used for guidance only.

7. Offsetting, right of retention

7.1 The Customer agrees not to set-off or purport to set off any claims it may have or allege to have against any sums owing to Kärcher.

8. Warranty

8.1 Defective goods are subject to the applicable statutory provisions. For claims for compensation due to defective goods, the limits as set out in § 10 shall apply. Kärcher’s warranty for its goods is as follows:

Warranty applicable for consumers only

6 months of warranty is given to garden pumps and steam ironing stations. Outdoor machines (high pressure cleaners) are given 1 year warranty; Indoor machines (vacuum cleaners, steam cleaners, electric brooms, floor polishers, window cleaners) are given 2 years warranty.

Exclusion - Consumable items referred as accessories such as filters, brushes, hoses, batteries, cloths and other normal wear and tear parts are excluded under this warranty.

8.2 Kärcher will not be liable for any claims that arise from:

8.2.1 normal wear and tear from normal use of the goods;

8.2.2 damage occurring after delivery of the goods to the Customer attributed to incorrect handling, storage or installation, non-observance of installation or handling instructions, excessive use or a lack of maintenance or care; and/or

8.2.3 damage or deterioration of the goods or damage attributed to force majeure, in particular external influences not stipulated in the contract or use of the goods for any other than that stipulated in the contract or normal use of the goods.

9. Compensation, limitation of liability

9.1 Kärcher is only liable for compensation in cases of willful conduct or gross negligence and the quantum of liability shall be limited to [ ? ] times the price of the goods. Kärcher’s liability for any losses howsoever or whatsoever caused by any negligent acts on its part or that of its agents or servants (other than gross negligence) shall be excluded except in cases resulting in death or personal injury to any person.

10. Privacy statement

10.1 Kärcher will handle all data collected from its customers in accordance with its prevailing Privacy Statement.

11. Applicable law, final provisions

11.1 These Terms shall be governed by the law of the Republic of Singapore.

11.2 All contracts concluded between Kärcher and the Customer shall consist of the Purchase Agreements reached between Kärcher and the Customer. There shall be no verbal supplemental agreements.

11.3 Kärcher reserves the right to change, modify or otherwise alter these Terms at anytime. The Customer is advised to review the Terms periodically.

11.4 If any clause or paragraph of these Terms is held invalid or is otherwise unenforceable or illegal the remainder of these Terms shall not also be invalidated or affected.

11.5 The Customer acknowledges and agrees that the use of the client’s credit card and the use of the password provided to the customer necessary to complete the Purchase Agreement and the final sales confirmation that may be printed out by the Customer shall be treated as a reasonable security procedure to verify that the Purchase Agreement (as evidenced by the final sales confirmation) has not been altered up to the time of the final sales confirmation up to any point in time when the electronic record needs to be verified within the meaning of the Electronic Transactions Act 2010. The Customer further agrees that the password provided by Kärcher shall be treated as a secure electronic signature within the meaning of the same Electronic Transactions Act 2010.
